In California probate matters, attorney’s fees follow a statutory formula set forth in California Probate Code Section 10810 and are paid only after court approval. These fees are calculated on the gross value of the estate using a sliding scale: 4% on the first $100,000, 3% on the next $100,000, 2% on the next $800,000, 1% on the next $9,000,000, 0.5% on the next $15,000,000, and a reasonable amount determined by the court for estates over $25,000,000.

In certain cases, the court may also approve extraordinary fees under Probate Code Section 10811 for services beyond standard estate administration, such as litigation, real property sales, tax preparation, or will contests.
