PROBATE

Probate is a court-supervised process of distribution of a decedent’s property. If you die with a will or without a will leaving substantial assets, your estate is likely to be subject to probate. Also, if you fail to retitle your assets in the name of your trust, these assets may need to be probated upon your death. Each probate is different. Some probate cases last years, while others are completed in six months.

Probate cases are intimidating. I will guide you through the process and supervise your progress. I am available for any questions any time. I will file all necessary documents, appear at court hearings if any, provide required notices to government agencies, and cooperate with an appraiser, realtor, title officer, escrow officer, CPA, etc.

Attorney’s fees in probate matters are paid after the court’s approval. In California, there is a special statutory formula used to calculate attorney’s fees.
